Russia's AI Law

The Russian AI law sets out a legal framework for the regulation of AI in Moscow for period of 5 years. The framework began on the 1st of July 2020 and is set to continue until the 1st of July 2025.

On the 15th February 2024, the Russian President made amendments to the legislation and approved the following strategy for a period of up to 2030.

Chapter II

Chapter II of the framework highlights the development of Artificial Intelligence in Russia and the world. 

Section 12 and 13 of the Russian AI Law outline Russia’s potential in becoming one of the International leaders in the development of AI technologies and its opportunity to occupy a significant share of the market. The implementation of this strategy is a perquisite for the Russian federation to join the world leaders in the development of AI.

The primary aim of this chapter is to highlight the expanding rate of AI and provide an overview of its developments to date. Section 17 especially outlines Russia’s results in the development of AI as of the 4th quarter of 2023.

Chapter III

Chapter III moves to focus on the Basic principles of development and use of AI technologies. Section 19 states the basic principles which are mandatory as of the implementation of this strategy are:

  1. Protection of human rights and freedoms: ensuring the protection of human rights and freedoms guaranteed by the legislation of the Russian Federation, international treaties of the Russian Federation and generally recognized principles and norms of international law, including the right to work, and providing citizens with the opportunity to acquire knowledge and acquire skills for successful adaptation to the conditions of the digital economy;
  2.  Security: the inadmissibility of the use of artificial intelligence for the purpose of intentional harm to citizens and organizations, the prevention and minimization of the risks of negative consequences of the use of artificial intelligence technologies (including non-compliance with the confidentiality of personal data and the disclosure of other restricted information), as well as the use of artificial intelligence in order to ensure information security;
  3. Transparency:  explainibility of the work of artificial intelligence and the process of achieving its results, non-discriminatory access of users of products that are created using artificial intelligence technologies to information about the algorithms of artificial intelligence used in these products;
  4. Technological sovereignty: ensuring the necessary level of independence of the Russian Federation in the field of artificial intelligence, including through the preferential use of domestic artificial intelligence technologies and solutions in the field of artificial intelligence, in the long term ensuring the development of artificial intelligence on domestic software and hardware systems;
  5. Integrity of the innovation cycle: ensuring close interaction of research and development in the field of artificial intelligence (including fundamental research) with the real sector of the economy;
  6. The most effective use of artificial intelligence technologies: the use of existing mechanisms for the implementation of state policy in the scientific and technical field and other areas as a matter of priority;
  7. Support for competition: the development of market relations and the inadmissibility of actions aimed at monopolizing and restricting competition between Russian organizations operating in the field of artificial intelligence;
  8. Openness and accessibility: prevention of restriction of access of organizations – developers of domestic artificial intelligence technologies, citizens, organizations operating in various sectors of the economy and social sphere (hereinafter referred to as industry organizations) to such technologies, with the exception of technologies in the areas of state and municipal administration and the military-industrial complex;
  9. Continuity: ensuring the gradual transition of public authorities to the use of artificial intelligence technologies;
  10. Security: security and legal protection of artificial intelligence technologies, delimitation of responsibility of organizations – developers and users of artificial intelligence technologies based on the nature and degree of damage caused, as well as protection of these users from the illegal use of artificial intelligence technologies;
  11. Reliability of the initial data: methodological and technological support of the reliability of the initial data, contributing to the minimization or elimination of the threat of negative impact on them.

Chapter V

Chapter V states the main objectives and goals in the development of AI technologies. These are;  to ensure the growth of the well-being and quality of life of its population, to ensure national security and law and order, to achieve sustainable competitiveness of the Russian economy, including leading positions in the world in the field of artificial intelligence. As per Section 23.

In addition, Section 28  outlines the indicators which characterise the achievement relating to the goals outlined in Section 23.

 10 indicators are provided in the chapter, one example being (b) the total increase in gross domestic product due to the use of artificial intelligence technologies in 2030 should grow to at least 11.2 trillion.

This chapter also outlines the support for organisations that develop artificial intelligence technologies. Some support expected to be given includes; the development of entrepreneurship skills within the field of AI, state support for teams developing solutions within the field of AI. 7 other support options are noted within the chapter.

As well as this, this chapter outlines support for research and development through outlining 9 main areas for support. One example suggests (j) the formation of a unified mechanism for interaction between scientific groups on research in the field of AI.

The following subsection outlines the main areas for the implementation of trusted AI in public authorities. Once again 14 examples have been listed in the strategy. However, the key examples are as follows:

  1. inclusion by federal government bodies, other state bodies, bodies of the federal territory “Sirius” as a matter of priority of projects for the introduction of trusted artificial intelligence technologies (which should provide for the economic effect of their implementation and increase in the efficiency of the activities of public authorities) in the digital transformation programs of public authorities and the digital transformation strategies of the constituent entities of the Russian Federation in the mainstreaming of these programmes and policies;
  2. training of state civil servants and employees of federal bodies of state power, other state bodies, bodies of the federal territory “Sirius”, as well as employees of organizations providing information and technological support for the activities of these bodies, in order to form their competencies that allow them to use trusted artificial intelligence technologies and large fundamental models to perform current tasks.

Section 51 states that the main goal of improving the legal regulation of social relations relating to the development of AI should be the creation of favourable regulatory conditions for the development and implementation of AI technologies.

The main areas of expert, analytical support for this strategies implementation are listed in Section 51 as;

  1. measures to support the introduction of artificial intelligence technologies,
  2. measures to assess the effectiveness of research and development in the field of artificial intelligence
  3. measures to assess the personnel situation in the field of artificial intelligence, including the creation and application of mechanisms for monitoring the state of the labor market, analysis of the number of specialists operating in the field of artificial intelligence, forecasting the need for such specialists, including by sectors of the economy and the social sphere, analysis of measures to stimulate demand for relevant specialists, as well as the level of their training
  4. creation of tools for monitoring the availability of data belonging to public authorities and organizations, including a system for monitoring the relevance and availability of data, a system for assessing the demand for data, a system for monitoring the duration of access to data;
  5. measures in the field of legal regulation and ethics of the use of artificial intelligence technologies
  6. formation of a system of state monitoring of the development of artificial intelligence technologies, including by sectors of the economy and the social sphere;
  7. measures to promote the best practices of the Russian Federation in the field of legal regulation and ethics of the use of artificial intelligence technologies at the sites of the relevant intergovernmental and international organizations, participation in the international exchange of expert and analytical information in volumes that meet the national interests of the Russian Federation;
  8. measures to assess the risks of using artificial intelligence technologies for citizens;
  1. creation of unified systems for evaluating decisions in the field of artificial intelligence;
  2. j) analysis of the economic efficiency of the introduction of artificial intelligence technologies;
  3. k) assessment of the ratio of the organization’s expenses for the introduction and use of artificial intelligence technologies and the profit received in this regard
 

Chapter VI

This chapter focuses on the mechanisms for the implementation of this strategy.

The implementation of this strategy is to be ensured by the Government of the Russian Federation, foreign bodies of state power and bodies for the federal territory “Siruis”. This is noted in Section 52.

Section 54 highlights the main mechanisms for the implementation of this strategy:

  1. a roadmap for the development of the high-tech direction “Artificial Intelligence” for the period up to 2030, including measures for the implementation and development of artificial intelligence of the federal project “Artificial Intelligence” of the national program “Digital Economy of the Russian Federation” and the national project for the formation of a data economy for the period up to 2030, as well as relevant action plans of interested organizations;
  2. national projects and state programs of the Russian Federation, including measures for the development of artificial intelligence technologies;
  3. strategies for the digital transformation of state corporations, state-owned companies and joint-stock companies with state participation, including measures for the introduction and development of artificial intelligence technologies.

The strategy is to be adjusted every 3 years by the decision of the president, on the basis of proposals by the Government of the Russian federation.
